Your use and continued usage of the Website (irrespective of the amendments made from time to time) shall signify your acceptance of the Terms of Usage and your agreement to be legally bound by the same.

General Description

The Website is an internet-based portal having its existence on the World Wide Web, application and other electronic medium, and provides astrological content, reports, data, telephone, video and email consultations (hereinafter referred to as “Content”). The Website offers “Free Services” and “Paid Services” (collectively referred to as “Services”). Free Services are easily accessible without becoming a member; however, for accessing personalized astrological services and/or additional Content and Paid Services, You are required to register as a member. By registering for Paid Services, a Member agrees:

• To provide current, complete and accurate information about himself/herself as prompted by the Website.
• To maintain and update the above information to keep it current and complete.

Registration and Eligibility

The User of the Website must be a person who can form legally binding contracts under the Indian Contract Act, 1872. A minor under the age of eighteen (18) is not permitted to avail the services provided on the Website without a legal guardian in accordance with applicable laws. The Website would not be held responsible for any misuse that may occur by virtue of any person, including a minor, using the services provided through the Website.

An account may be created through the Website ID (Your Phone Number) and password (OTP), or other log-in ID and password which can include a Facebook, Gmail or any other valid email ID. The User represents and warrants that all information provided is current, accurate and complete. Use of another User's account is expressly prohibited. If the information supplied is found to be inaccurate, incomplete, untrue or not current, the Website has the right to suspend or terminate the User's account.

The right to use this Website is personal to the User and is not transferable. The User is responsible for protecting the confidentiality of passwords and other registration information and is fully responsible for all activities under the User's account. The User shall notify the Website immediately upon becoming aware of any unauthorized use of their account or breach of security, and must log out at the end of each session.

The User agrees, understands and confirms that personal data, including without limitation debit card/credit card details transmitted over the Internet, may be susceptible to misuse, hacking, theft and/or fraud, and that the Website or the Payment Service Provider(s) have no control over such matters.

The Website does not permit the use of the Services by any User: if the User is a resident of any jurisdiction that prohibits the use of such services; if prohibited by law, regulation, treaty or administrative act; due to any religious practices; or if the User has created multiple accounts using various mobile numbers (a User may not have more than one active account).

The Website provides a service available through the medium of telecommunication with the Panditji, Vastu experts, Astrologer Advisors and online teachers listed and enrolled with the Website. By agreeing to these Terms of Usage, you also give your unconditional consent to the Website to arrange a call with you on your mobile number even though your number may be registered on the DND service provided by your mobile service provider.

Website Content

• The Website and any individual websites available through external hyperlinks are private property.
• All interaction on this Website, inclusive of guidance and advice received from the Licensed Provider, must comply with these Terms of Usage.
• The User shall not post or transmit any material which is unlawful, abusive, defamatory, invasive of privacy, vulgar, obscene, profane or otherwise objectionable, or which encourages criminal conduct or civil liability.
• The Website may suspend or terminate access, and reserves the right to change or discontinue any aspect or feature of the Website including content, graphics, deals, offers and settings.
• Any information other than guidance and advice, including educational, graphics and research sources, should not be considered as medical advice. The Website does not guarantee any medical advice provided by third-party service providers. Users should always consult an appropriately qualified health care professional. Namastepanditji does not endorse any specific tests, medications, products or procedures.
• The Website does not guarantee any results as expected by the User; accessing the Website in such a scenario is purely at the risk of the User.
• Any legal remedy or liability sought for the actions or omissions of other Members or third parties shall be limited to a claim against such particular party.

User Account Access

The Website shall have access to the account and information created by the User for ensuring and maintaining high-quality services and for addressing customer needs effectively. The User consents to the unconditional access of the account by the Website, its employees, agents and other appointed persons for the purpose of addressing complaints and any suspected abuse. The User is directed to read the terms provided in the Privacy Policy regarding such records.

Pricing Policy

Price Range: At Namastepanditji.co.in we have customised pricing according to the services rendered. Typically, the range of transactions on our Android and iOS applications varies from INR 500 to 1500 per user per session.

Schedule of payment: Some services can be utilised for fixed durations, clearly mentioned within the description. The period of usage varies from 1 month to 6 months.

Price matching: We are committed to offering the best possible prices and will be glad to meet a competitor's pricing for the same service, interest, professionalism and features. Our prices do not vary according to market needs or competitor pricing.

Sale adjustment: If a purchased service is reduced in price within one week of your booking date, we will not be able to adjust the sale price. If you have booked a slot for a date, generally we cannot reschedule the slot to another date; this will result in cancellation of the booking. Please refer to the Cancellation Policy for details.

Pricing errors: Despite our efforts, pricing errors may still occur. If a service's price is higher than the price displayed, we will cancel your booking and notify you. See the full Pricing Policy.

Breach and Termination

The Website may, in whole or in part, without informing the User, modify, discontinue, change or alter the services ordered or the account of the User. The Website may or may not issue notice or provide any reason for such action. Violation of any conditions mentioned in these Terms of Usage shall lead to immediate cancellation of the User's registration. The Website reserves the right to terminate and initiate action immediately if it cannot verify the Registration Data, if it believes the User's actions may cause legal liability, or if the User has provided false and misleading Registration Data or interfered with other Users or the administration of the services.

Delivery, Cancellation and Refund

• No refund shall be processed on the order of any reports once the order has reached the “processing” (assigned) stage.
• No refund shall be processed once an order has been placed and executed. To cancel a successfully placed order before execution, the User must contact customer care within 1 (one) hour of making the payment, whereafter a refund is at the discretion of the Website.
• Any technical delay or glitch during processing shall not be eligible for a refund. Timelines are approximate.
• No refund shall be processed where incorrect information or data has been provided by the User.
• No refund shall be processed for the return of any damaged product. For “Cash on Delivery” orders returned, the User shall be charged for the cost of the product plus shipping/custom/courier charges as applicable.
• No refund shall be processed for providing a wrong contact number for the “Call with Astrologer” feature, or for any call which gets connected.
• Refunds, if any, shall be processed after deduction of transaction charges levied by the Bank and/or Payment Gateway, shipping/courier charges, customs duty (if levied) and any other charges incurred.
• In case of duplicate payments due to server issues, the excess shall be refunded in full without deduction; the Website retains the cost of one single order.

User Obligation

The User is under an obligation not to violate the Privacy Policy, terms and conditions and any other terms defined on the Website. The User shall not, among other things:

• Post, publish or transmit any messages that are false, misleading, defamatory, harmful, threatening, abusive, harassing, that invade another's privacy, or that promote racism, hatred or harm against any individual, group, religion or caste, or that infringe another's rights.
• Upload or make available any content the User does not have a right to make available, or that infringes any patent, trademark, trade secret, copyright or other proprietary rights.
• Collect screen names and email addresses of members for advertisement, solicitation or spam.
• Send unsolicited email, junk mail, spam or chain letters.
• Upload or distribute files that contain viruses or corrupted files.
• Interfere with or disrupt access to the Website, or attempt to gain unauthorized access by hacking, password mining or other illegitimate means.
• Violate any applicable laws or regulations, resell or make commercial use of the Services without express written consent, or reverse-engineer, copy, distribute or sell any information or software obtained from the Website.

By becoming a registered member, the User agrees to receive certain specific emails, SMS and calls from the Website, and agrees not to transmit any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. The User is under an obligation to report any misuse or abuse of the site to Customer Care. Any false complaint made by a Member may make such Member liable for termination of membership without refund.

Bank Account Information

The User is under an obligation to provide banking information as and when required. The User agrees that the debit/credit card details provided must be correct and accurate, that the User shall not use a card not lawfully owned or authorized, and that the User is fully and lawfully entitled to use such card or bank account and to ensure sufficient credit is available. If any part of these Terms is determined to be invalid or unenforceable, the invalid provision will be deemed superseded by a valid, enforceable provision that most closely matches the original intent, and the remainder shall continue in effect.

Disclaimer / Limitation of Liability / Warranty

To the maximum extent permitted by applicable law, the Website does not provide warranties for the service. Astrological counselling provided through the Website is based on the cumulative or individual knowledge, experience and interpretations of astrologers and may vary from one astrologer to another. The Website offers services through a diverse panel of astrologers/pandits duly verified by the Website. Such recommendations (mantras, yantras, gemstones or other astrological remedies) are made in good faith, and the Website makes no warranty that: the service will meet your requirements; the service will be uninterrupted, timely, secure or error-free; the results obtained will be accurate or reliable; the quality will meet your expectations; or that any errors will be corrected.

The Website, services and other materials are provided on an “as is” basis without warranty of any kind, express, implied, statutory or otherwise, including the implied warranties of title, non-infringement, merchantability or fitness for a particular purpose.

The Services provided by the Website are for entertainment purposes only. Namastepanditji charges for the chat/call service on a per-minute basis and holds no responsibility or liability about the reality or reliability of the astrological effects on human physiology by the gems, products or services represented and sold on the Website.

The advisors/consultants/astrologers are members of the site and not employees of the Website or the company. The Website verifies the degrees, qualifications, credentials and background of the advisors but does not refer, endorse, recommend, verify, evaluate or guarantee any advice, information or other services provided by them.

The Website is not a suicide helpline platform. If you are considering or contemplating suicide or feel that you are a danger to yourself or others, please discontinue use of the services and notify appropriate police or emergency medical personnel. If you are thinking about suicide, immediately call a suicide prevention helpline such as AASRA.

Notwithstanding anything to the contrary, Namastepanditji's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to the Website for the service during the term of membership.

Indemnification

The User shall indemnify, defend and hold harmless the Website and its parent, subsidiaries, affiliates, officers, directors, employees, suppliers, consultants and agents from any and all third-party claims, liability, damages and/or costs (including, but not limited to, attorney's fees) arising from Your use of the Services, Your violation of the Privacy Policy or these Terms of Service, or Your violation of any third party's rights.

Proprietary Rights to Content

The User acknowledges that the Content, including text, software, music, sound, photographs, video, graphics or other material, is protected by copyrights, trademarks, service marks, patents and/or other proprietary rights and laws. The User is not permitted to copy, use, reproduce, distribute, perform, display or create derivative works from the Content unless expressly authorized. Panditji Astrology & Pooja Services Pvt. Ltd. is not liable for any copyrights of content or data sourced from various online portals.

Notices

Except as otherwise stated, all notices to a party shall be in writing and made either via email or post. Notice shall be deemed given 24 hours after an email is sent, or 3 days after deposit in the post, to the Member at the address provided in the Registration Data, and to the Website at: Asopa Galli, Azad Chowk, Latur 413512, Maharashtra, India.

Governing Law and Jurisdiction

Any dispute, claim or controversy arising out of or relating to these Terms of Usage shall be determined by arbitration in India, before a sole arbitrator mutually appointed by the parties, conducted in accordance with the Arbitration and Conciliation Act, 1996. The seat of such arbitration shall be LATUR, and all proceedings shall be in the English language. The award shall be final and binding. These Terms of Usage shall be governed by and construed in accordance with the laws of India. The parties agree to submit to the exclusive jurisdiction of the courts located in LATUR.
