Panditji Partner Program — Terms & Conditions

1. Nature and Applicability of the Terms

• Terms shall include the present Service Terms and Conditions and the Privacy Policy, and both together shall constitute a legal agreement between You and Namastepanditji.
• Namastepanditji reserves the right to update, change, modify, add or remove these Terms, duly communicated via Email / Website Notification / Application / other messaging services. Your continued use signifies acceptance.
• After signing up, the below terms shall follow:
  • You are required to upload a recent profile picture as your specific identity. Once uploaded, the profile picture cannot be changed without raising a request. You are prohibited from using the same profile picture on any other platform. Violation attracts de-activation of your profile without warning and a fine of Rs. 5,000.
  • You agree not to disclose your personal identity on the profile. You will be assigned a specific display name; it cannot be changed without a request and cannot be used on any other platform.
  • You are prohibited from publicising your work carried out under the display name and profile picture at Namastepanditji without prior written permission.
  • You agree not to use the exact same display name and profile picture for a period of 5 years from the date of termination of this contract.
  • You agree not to disclose your real/full/alias name to any customer assigned to you. Violation attracts de-activation without warning and a fine of Rs. 10,000.
  • You declare that all information provided is true and correct. If any information is found to be untrue or wrong, a penalty of Rs. 21,000 shall be imposed and your profile shall be de-activated immediately.
• You agree that you shall not work/deliver similar services elsewhere over the internet using a disguised or alias name. Violation attracts de-activation without warning and a fine of Rs. 21,000.
• You agree not to open a similar platform for a period of 5 years from the cessation of your relationship with Namastepanditji, nor use the tag of Namastepanditji to lure customers.
• After your profile has been made live and upon termination, Namastepanditji shall have the right to display your profile for a continuous period of 2 (two) years if the profile has not been de-activated for violation.

2. Obligations and Performance

a. Zero Tolerance / Conduct

• You shall treat the customer in a cordial fashion. Use of filthy language or threats leads to deactivation for a minimum of eight (8) days and a penalty of Rs. 3,100 for re-activation. The period may be extended until the penalty is paid, whereafter a penalty of Rs. 100 per day applies.
• You are required to maintain proper decorum and answer all questions peacefully. You shall not upload or display customer personal information anywhere.
• You shall not upload, post, email or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of privacy or otherwise objectionable.
• You agree to use the paid conversation time productively. Unnecessarily dragging the call/chat for personal gain attracts a refund to the customer and a penalty of Rs. 500 for each violation.

b. Personal Information

• You shall not share any personal information (contact number, bank account details, emails, websites, social media profiles including Facebook, WeChat, WhatsApp, Telegram, Messenger, SMS, etc.) with any customer.
• You are not permitted to charge for a free service, nor ask the customer to deposit any amount in your personal account.
• Misuse or indirect sharing of personal information attracts a penalty of Rs. 11,000, immediate removal of the Green Tick and temporary de-activation.

c. Time Commitment

• You agree to spend a minimum of 6 (six) live hours on the Website (calculated on a weekly average) to increase your credibility.
• If live hours are less than 6 on a daily basis, the Namastepanditji verified Green Badge may be removed from your profile.

d. Misusing Website for Personal Gain

• You are strictly prohibited from promoting your personal products for personal gain by recommending and selling products not listed on Namastepanditji.
• You may get your products verified to be listed. Listing does not mean you may force customers to buy; imposing on customers (showing negative effects or threatening mishaps) is a violation.

e. Direct Contact Prohibition

• You are prohibited from obtaining the contact information of any customer and soliciting them to contact you personally. You agree to route all queries through the portal.
• Getting into direct contact with a customer for personal gain attracts damages of Rs. 11,000 for each violation and removal of the Green Tick.

f. Pure Advisory Services

• Namastepanditji does not promote or encourage superstition such as Tantra, Black Magic, Totke or Vasheekaran. You are advised to provide simpler remedies. Any advice relatable to loss or danger to life (animal or human) is a gross violation.
• You agree to respect other advisors listed on the Website and not defame or humiliate them. Such conduct attracts a penalty of Rs. 7,000.

g. Misuse of Credentials

• You agree not to share the credentials received through Namastepanditji with anyone. Violation attracts a penalty of Rs. 11,000 and profile deactivation.
• You agree not to impersonate any person or entity, or provide consultation through anyone else impersonating you. Such impersonation attracts criminal liability, a fine of Rs. 11,000 and profile deactivation.

h. Honest Price Commitment

• You agree to maintain your services at the fair price guaranteed by Namastepanditji, and not to sign up with any other portal at a similar or lower price. Violation attracts appropriate action under law and a penalty of Rs. 11,000.

i. Predictions

Namastepanditji prohibits predictions on sensitive issues, including: predicting the gender of an unborn child; providing dates/times for medical operations; predictions relating to any criminal offence; achieving success through illegal means; gambling, money-laundering or drug abuse; or predicting death for any reason. Violation attracts a penalty of Rs. 11,000 with immediate profile de-activation and black-listing. If a customer is not satisfied or the service could not be rendered, You shall refund the amount voluntarily. All chat and call consultations are recorded for quality purposes.

When answering reports, you will not copy/paste data from another app; you will type all answers yourself after deeply analysing the customer's problems and charts. Complaints of copied answers or poor report quality attract an immediate refund to the customer, a penalty of Rs. 5,000, closure of your report section and Green Tick removal.

3. Usage of Features

Next Online Time: After logging out, you shall mark the expected time of logging in again. Not doing so can negatively impact your profile.

Namastepanditji Verified Green Badge: You are eligible for a verified Green Badge by working exclusively for the Website a minimum of 6 hours daily. Removal for any violation attracts a payment of Rs. 11,000 for re-activation.

Reviews: Customers can give positive or negative reviews. You agree not to remove/delete any review; changes may be requested via the “My Review” tab.

Pricing: Pricing can be increased or decreased up to 20% after a gap of 30 days. Of the amount paid by the customer for a consultation, 50% is retained by Namastepanditji and 50% is deposited to your provided account details, subject to any offers/promotions provided to the customer (in which case a proportionally lower amount is paid).

Profile Update: A verified profile cannot be changed without prior approval and re-verification. Requests are raised by ticket from the dashboard.

Feature Updation: Namastepanditji reserves the right to update any feature; changes are communicated to your notice board/dashboard.

4. Refund and Cancellation

Any service rendered through the platform is chargeable. If a refund complaint is received from a user, it is subject to review by the Administrator/Compliance Team. If found genuine, the refund shall be processed (in full or partial) without seeking your approval, and Namastepanditji's decision shall be final. Once a refund is made, it is borne by both parties (You and Namastepanditji). The same applies to foreign users.

5. Indemnity

You undertake to indemnify the Website and its affiliates, directors, employees and officers against any claims, liabilities, actions, proceedings, demands and expenses which the Website may incur in connection with any proceeding arising out of your use of the platform or any unauthorised use and violation of the profile created and managed by you.

6. Governing Laws

The Courts situated at Latur shall have exclusive jurisdiction to entertain and decide any dispute arising between the parties under these Terms.

7. Dispute Resolution

Any dispute shall be settled by resorting to alternate modes of dispute resolution in the first instance, including Arbitration, Mediation and Conciliation. The award passed by the Arbitrator shall be final and binding on both parties.

8. Severability

If any provision of these Terms is held to be illegal, invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

9. Confidentiality and Non-Disclosure

You agree to hold the confidential information in the strictest confidence and to protect it from disclosure to any third party. It can be used only for the purposes of the Website under these Terms.

10. Other General Provisions

Limitation on Liability: Neither party will be liable for breach-of-contract damages that are remote or speculative, or that the breaching party could not reasonably have foreseen. Assignment: Neither party may assign these Terms without the other party's written consent.
